How best to realize international human rights law in practice has proved a vexing problem. The challenge is compounded in the USA, which has not ratified several treaties including the Convention on the Elimination of All Forms of Discrimination against Women. The Cities for CEDAW movement addresses this deficit by encouraging cities to endorse and implement CEDAW norms. In doing so, it seeks to catalyze a local boomerang effect, whereby progressive political momentum at the local level generates internal pressure from (...) below to improve gender equity outcomes across the country and eventually, at the national level. In this article, we trace the diffusion of Cities for CEDAW activism with attention to the case of Cincinnati and analyze its implications for advancing women’s rights principles. We argue that while Cities for CEDAW has potential to enhance respect for women’s rights in local jurisdictions, its impact on national policy remains limited. (shrink)

This study investigates the likelihood of director turnover following opportunistic insider selling. Given that opportunistic insider selling may be costly to a firm due to potential legal risk and firm legitimacy concerns, we hypothesize that directors engaging in this type of transactions have a higher likelihood of subsequently leaving the board. Using archival data of 11,409 directors in 2280 US firms from 2005 to 2014, univariate comparisons show that directors engaging in opportunistic insider selling are about 8% more likely to (...) exit their firms’ board compared to directors not engaging in this behavior. Furthermore, multivariate results show that the likelihood of director departure following opportunistic insider selling is higher for some directors but not all. Specifically, directors who are especially valuable to the board or costly to replace do not seem to experience elevated levels of turnover. Interestingly, this difference in director turnover is only observed in smaller firms. We find that in larger firms, the likelihood of director turnover following opportunistic insider selling does not depend on director characteristics. As such, results seem to suggest that boards do not homogeneously self-regulate in this context as some directors seem to be shielded from turnover following unethical behavior. (shrink)

KegleyAll philosophy, whether or not we want to admit it, is done in a context, filtered through lenses that are personal, intellectual, historical, cultural, social, and political. Thus to fairly treat and fully understand Royce's views on race, we must set a situational framework. First, Royce's 1906 article entitled "Race Questions and Prejudices" is the lead piece in a collection that (...) implements his philosophy of loyalty. It applies his principle of loyalty to what he considers one of the most significant social/political issues of his time—the race question. As we discuss Royce and race issues, the philosophy of loyalty must be in the background as a point of reference. Indeed, Royce tells us that he will address the various questions in his article "Race Questions and Prejudices" by calling attention to "a few principles which seem to me to be serviceable to any one who wants to look at race questions fairly and humanely" (6).Secondly, except for W. E. B. DuBois and Jane Addams, no other major figure associated with pragmatic philosophy substantially addressed issues of race and racism in their written work, nor did anyone so early in the twentieth century as did Royce. DuBois's The Souls of Black Folk, which came out in 1903, immediately preceded Royce's article. Jane Addams briefly touched on race issues in her 1915 Democracy and Social Ethics. Alain Locke, who sought to study with Royce at Harvard but could not because of Royce's premature death, gave his "Lectures on the Theory and Practice of Race" in 1915, but they were published posthumously. John Dewey's "Race Prejudice and Friction" appeared in 1922. There is an absence of treatment of race issues in George Herbert Mead, Charles Sanders Peirce, and Alfred North Whitehead. Thus Shannon Sullivan and I agree that Royce stands out in the history of classical American philosophy in taking an antiracist focus on race questions when very few philosophers—especially white male philosophers—took scholarly time to think about these issues.1 [End Page 1]Another important context for Royce's article is the political climate of the time. Royce identifies the era as one in which there were "more ways and places in which men find themselves in the presence of alien races with whom they have to live in the same social order" (4). It was a time of "white anxiety." In 1905, Theodore Roosevelt gave his famous "On American Motherhood" speech in which he warned of white "race suicide" if white families continued to reproduce at a slower rate than other races. Thus, Royce was speaking and writing against racism in a time of anti-immigration and proimperialism sentiment due to white anxiety in the United States about the possible decline of global white supremacy. It is in this setting that Royce highlights the color line as a significant problem.Royce states the problem as follows:This is the problem of dealing with the men who seem to us somehow very widely different from ourselves in physical constitution, in temperament, in all their deeper nature, so that we are temped to think of them as natural strangers to our souls, while nevertheless we find that they are stubbornly there in our world and that they are men as much determined to live as we are, and are men who, in turn, find us as incomprehensible as we find them.(5)With increased contact among different populations, the age-old problem of how to deal with people who seem different from one's own group intensifies. There will be, says Royce, numerous questions including those of superiority-inferiority, power and sovereignty, and a new assessment of the ways in which these "different" people might be helpful or perilous to one's own group interests. I believe that the long-neglected ideas on science and scientific method of Charles Sanders Peirce and Josiah Royce can illuminate some of the current attacks on science that have surfaced: misconduct and fraud in science and anti-scientism or the "new cynicism." In addition, Royce and Peirce offer insights relevant to the ferment in contemporary philosophy of science around the various forms of pluralism advocated by a number of philosophers (see Kellert, Longino, and Waters). Searching for common ground in philosophy, science and theology, it seems to us that it would be reasonable to maintain the position of realistic pragmatism that Charles Sanders Peirce had called pragmaticism. In the pragmaticist manner, we typify the knowledge and select the types of knowledge that might be useful for understanding the problems that are of interest to us. We pose a question of how it would be possible to obtain practically useful information about reality, first from the perspective (...) of natural sciences, and then from that of theology; that is, to diversify the ways of knowledge and just maybe, to move toward a productive dialogue between science and religion. The adoption of web-based telecare services has raised multifarious ethical concerns, but a traditional principle-based approach provides limited insight into how these concerns might be addressed and what, if anything, makes them problematic. We take an alternative approach, diagnosing some of the main concerns as arising from a core phenomenon of shifting trust relations that come about when the physician plays a less central role in the delivery of care, and new actors and entities are introduced. Correspondingly, we propose an (...) applied ethics of trust based on the idea that patients should be provided with good reasons to trust telecare services, which we call sound trust. During the past few decades, a radical shift has occurred in how philosophers conceive of the relation between science and philosophy. A great number of analytic philosophers have adopted what is commonly called a ‘naturalistic’ approach, arguing that their inquiries ought to be in some sense continuous with science. This research examines how the fit between employees moral development and the ethical work climate of their organization affects employee attitudes. Person-organization fit was assessed by matching individuals' level of cognitive moral development with the ethical climate of their organization. The influence of P-O fit on employee attitudes was assessed using a sample of 304 individuals from 73 organizations. In general, the findings support our predictions that fit between personal and organizational ethics is related to higher levels of commitment and (...) job satisfaction and lower levels of turnover intent. Ethical P-O fit was related to higher levels of affective commitment across all three ethical climate types. Job satisfaction was only associated with ethical P-O fit for one of the three P-O fit variables and turnover intentions were significantly associated with two of the ethical P-O fit variables. The most consistent effect was found for the Conventional - Caring fit variable, which was significantly related to all three attitudes assessed. The weakest effect was found for the Preconventional - Instrumental fit variable, which was only predictive of affective commitment. The pattern of findings and implications for practice and future research are discussed. (shrink)

This book shows why we can justify blaming people for their wrong actions even if free will turns out not to exist. Contrary to most contemporary thinking, we do this by focusing on the ordinary, everyday wrongs each of us commits, not on the extra-ordinary, “morally monstrous-like” crimes and weak-willed actions of some.

I try in this essay to accomplish two things. First I offer some first thoughts toward a clarification of the ethical foundations of private property rights that avoids pitfalls common to more strictly Lockean theories, and is thus better prepared to address arguments posed by critics of standard private property arrangements. Second, I'll address one critical argument that has become pretty common over the years. While versions of the argument can be traced back at least to Pierre Joseph Proudhon, I'll (...) focus on a formulation given it by Jeremy Waldron. The basic idea is that the only sound arguments for private property rights lead to the conclusion that society has an obligation to insure that every citizen possess private property. In Waldron's formulation, what is justifiable is a general, rather than a special, right to private property. I shall try to suggest that this conclusion is unwarranted. (shrink)

Human life is operationally defined by the onset and cessation of organismal function. At postnatal stages of life, organismal integration critically and uniquely requires a functioning brain. In this article, a distinction is drawn between integrated and coordinated biologic activities. While communication between cells can provide a coordinated biologic response to specific signals, it does not support the integrated function that is characteristic of a living human being. Determining the loss of integrated function can be complicated by medical interventions that (...) uncouple elements of the natural biologic hierarchy underlying our intuitive understanding of death. Such medical interventions can allow living human beings who are no longer able to function in an integrated manner to be maintained in a living state. In contrast, medical intervention can also allow the cells and tissues of an individual who has died to be maintained in a living state. To distinguish between a living human being and living human cells, two criteria are proposed: either the persistence of any form of brain function or the persistence of autonomous integration of vital functions. Either of these criteria is sufficient to determine a human being is alive. (shrink)

In this paper we present a new proposal for defining actual causation, i.e., the problem of deciding if one event caused another. We do so within the popular counterfactual tradition initiated by Lewis, which is characterised by attributing a fundamental role to counterfactual dependence. Unlike the currently prominent definitions, our approach proceeds from the ground up: we start from basic principles, and construct a definition of causation that satisfies them. We define the concepts of counterfactual dependence and production, and put (...) forward principles such that dependence is an unnecessary but sufficient condition for causation, whereas production is an insufficient but necessary condition. The resulting definition of causation is a suitable compromise between dependence and production. Every principle is introduced by means of a paradigmatic example of causation. We illustrate some of the benefits of our approach with two examples that have spelled trouble for other accounts. We make all of this formally precise using structural equations, which we extend with a timing over all events. (shrink)

Expressive-Assertivism, a metaethical theory championed by Daniel Boisvert, is sometimes considered to be a particularly promising form of hybrid expressivism. One of the main virtues of Expressive-Assertivism is that it seems to offer a simple solution to the Frege-Geach problem. I argue, in contrast, that Expressive-Assertivism faces much the same challenges as pure expressivism.

Val Plumwood’s 1993 paper, “The politics of reason: towards a feminist logic” (hence- forth POR) attempted to set the stage for what she hoped would begin serious feminist exploration into formal logic – not merely its historical abuses, but, more importantly, its potential uses. This work offers us: (1) a case for there being feminist logic; and (2) a sketch of what it should resemble. The former goal of Plumwood’s paper encourages feminist theorists to reject anti-logic feminist views. The paper’s (...) latter aim is even more challenging. Plumwood’s critique of classical negation (and classical logic) as a logic of domination asks us to recognize that particular logical systems are weapons of oppression. Against anti-logic feminist theorists, Plumwood argues that there are other logics besides classical logic, such as relevant logics, which are suited for feminist theorizing. Some logics may oppress while others may liberate. We provide details about the sources and context for her rejection of classical logic and motivation for promoting relevant logics as feminist.
